GENERAL TERMS AND CONDITIONS

(GTC)

Effective from: 1 November 2015 until revoked

These General Terms and Conditions (hereinafter: GTC) govern the conditions of participation in courses, lectures, workshops and festivals organized and hosted by Cartebor Ltd. (hereinafter: Cartebor Ltd., registered office: 8200 Veszprém, Takácskert u. 1C., tax number: 12661774-1-19), as well as the general conditions of product purchases by Clients/Users/Customers (hereinafter collectively referred to as the Client), and define the rights and obligations arising from the legal relationship between Cartebor Ltd. and the Client.

The provisions of these GTC shall apply to all legal relationships established through the use of services provided via the websites operated by Cartebor Ltd. (www.horvathbrigi.com). The GTC are published on the website, where they can be read and printed, and are also available at the company’s registered office.

1. Definitions

1.1. Event:
Any course, lecture, workshop or event organized by Cartebor Ltd., or a course, examination, educational event, lecture or workshop organized by a third party.

1.2. Service:
Any service provided by Cartebor Ltd., either free of charge or for consideration.

1.3. Ticket:
A confirmation issued upon ticket purchase, entitling participation in an Event organized by Cartebor Ltd.

1.4. Product:
Intellectual or physical products developed or distributed by Cartebor Ltd., advertised on its websites (e.g. board games, cards, digital/audio products, books, publications).

2. Scope

2.1. These GTC are concluded for an indefinite period.

2.2. The Visitor acknowledges that Cartebor Ltd. is entitled to unilaterally amend these GTC for justified reasons. Such reasons include changes in mandatory legal provisions, requirements for the safe or economical organization of Events, public safety or public health considerations, changes in work processes, or domestic or international economic and market conditions. Amendments shall enter into force immediately upon publication on the website.

Right of Withdrawal:
If an amendment affects the legal relationship defined in Section 4.2, the Contracting Parties may withdraw from the contract in writing without justification within fourteen (14) days from the effective date of the amendment, provided that participation in the Event has not yet commenced. No right of withdrawal exists if the amendment is exclusively beneficial to the Client.

3. Contractual Relationship

3.1. Upon payment of the consideration for a Product or Service and confirmation by Cartebor Ltd., a contractual relationship is established between the Parties. Cartebor Ltd. shall deliver the Product or provide participation in the relevant Event.

3.2. The content and quality of Products and Services are designed and developed by Cartebor Ltd., with a constant focus on high quality and reliability.

3.3. Provisions regarding children’s brain control courses are set out in the supplementary sections.

4. Registration, Application, Purchase

4.1. Current prices of Products and Services are available on the websites of Cartebor Ltd.
(www.horvathbrigi.com, www.cartebor.hu)

4.2. Application for Training

4.2.1. Applications for youth athletes and participants in brain control courses are submitted via direct contact. Applications for participants under 18 years of age may only be submitted by a parent or legal guardian. Personal data are handled in accordance with the Privacy Policy.

4.2.2. Applications for SportHack, MemoHack and Change Training courses are submitted via an online application form or direct contact. Data are processed in accordance with the Privacy Policy.

4.3. Product Purchase

Products distributed or published by Cartebor Ltd. may be ordered via the website. Payment options:

  1. OTP SimplePay card payment: an invoice is issued automatically after successful payment.

  2. Bank transfer: the Customer receives a payment request; the invoice is issued upon receipt of payment and sent by email.

Products are shipped within 3–6 business days. Complaints may be submitted to the Managing Director at the above email address.

4.4. Personal Purchase

Personal purchases may be made at locations specified on the website, by prior appointment and cash payment. Invoices are issued electronically.

4.5. Event Engagements

Cartebor Ltd. undertakes event appearances based on a separate contract.

5. Code of Conduct and Recordings

Participants must comply with general rules of conduct, these GTC and the house rules of the venue, and refrain from any conduct that may violate or endanger the rights, health or safety of others.

Without prior written permission, promotional, advertising, commercial activities or fundraising at Events are prohibited.

Cartebor Ltd. may create photo and audio recordings at Events. By participating, the Client consents to the recording and use of their image and statements. Naming is only permitted with explicit consent, except for public figures.

Recordings may be used without restriction and without compensation to the Client for promotional or other purposes.

Clients may take photos at Events for non-commercial use only, provided Cartebor Ltd. is clearly referenced.

6. Liability

Cartebor Ltd. is not responsible for unattended personal belongings.

Clients are responsible for the accuracy of provided data.

Cartebor Ltd. shall not be liable for misuse related to payment methods.

Clients bear full civil and criminal liability for damages caused by them.

7. Copyrights and Trademarks

All logos, trademarks, materials and content appearing online or offline are the exclusive property of Cartebor Ltd. or its partners and may not be used without prior written consent.

Feedback and suggestions submitted by Clients may be used freely without compensation.

8. Force Majeure

Neither party shall be liable for failure to perform due to unforeseeable and unavoidable events such as war, strikes, natural disasters, pandemics or fire.

9. Final Provisions

Hungarian law shall apply.
The exclusive jurisdiction shall be the District Court of Veszprém.
